Which Regulations Apply to Your Financial Services Firm?

1

Do you have material financed or facilitated emissions in your portfolio?

Yes → PCAF-aligned Scope 3 Category 15 measurement is critical. UK SRS S2 requires financed emissions disclosure on a comply-or-explain basis from January 2027.

2

Do you offer investment products with sustainability features or claims?

Yes → FCA SDR labels apply. You must assess eligibility for one of the four sustainability labels or remove sustainability claims from product naming and marketing.

3

Are you listed on the London Stock Exchange or subject to FCA PS26/19?

Yes → Transition plan disclosure is required on a disclose-or-explain basis from January 2027, aligned to the TPT framework.

4

Do you market funds into the EU or manage EU-domiciled funds?

Yes → EU SFDR applies. Article 6/8/9 classification, PAI statements, and pre-contractual disclosures are mandatory for EU-facing products.

5

Do you struggle with inconsistent, incomplete, or unauditable ESG data from investees?

Yes → ESG data architecture is foundational. Without reliable investee data, SDR labels, financed emissions, and transition plans all lack credibility under regulatory scrutiny.

The Challenge

Why Financial Services Firms Can’t Afford to Wait

Regulatory convergence, greenwashing enforcement, and data gaps are creating unprecedented compliance pressure across UK financial services.

Financed Emissions (Scope 3 Cat 15)

For banks, asset managers, and insurers, Scope 3 Category 15 financed emissions typically dwarf operational Scope 1 and 2 by 100x or more. Measuring, attributing, and reducing portfolio-level emissions across thousands of investees requires PCAF-aligned methodologies and robust data pipelines that most firms lack.

Greenwashing Risk (FCA Enforcement)

The FCA anti-greenwashing rule (effective May 2024) requires all sustainability-related claims to be fair, clear, and not misleading. With FCA enforcement actions, CMA scrutiny, and reputational risk from consumer complaints, firms face material exposure from product naming, marketing materials, and fund documentation that overstates sustainability credentials.

Transition Plan Disclosure (PS26/19)

FCA PS26/19 requires listed financial services firms to disclose TPT-aligned transition plans on a disclose-or-explain basis from January 2027. This demands credible strategic ambition, quantified interim targets, implementation actions with accountability, engagement strategies for portfolio companies, and governance oversight — far beyond current TCFD practice.

ESG Data Quality

ESG data from investees is inconsistent, often estimated, rarely audited, and varies across data providers. Without a robust data architecture covering collection, validation, gap-filling, and audit trails, every downstream output — SDR labels, financed emissions, transition plans, SFDR disclosures — is built on unreliable foundations.

Financial Services ESG: Frequently Asked Questions

What are the four FCA sustainability labels and which products qualify?+
The four FCA sustainability labels are: Sustainability Focus (at least 70% of assets meet a credible standard of environmental or social sustainability), Sustainability Improvers (assets with potential to improve sustainability over time through stewardship), Sustainability Impact (assets that achieve a pre-defined, positive, measurable real-world sustainability outcome), and Sustainability Mixed Goals (a combination of the above). Products must meet qualifying criteria including investment strategy, KPIs, stewardship approach, and ongoing monitoring. Labels are voluntary but the anti-greenwashing rule applies to all firms.
How should financial services firms measure financed emissions?+
The Partnership for Carbon Accounting Financials (PCAF) Global GHG Accounting and Reporting Standard is the leading methodology. It provides asset-class-specific approaches for listed equity, corporate bonds, business loans, project finance, commercial real estate, mortgages, motor vehicle loans, and sovereign debt. Each asset class has a defined attribution methodology and data quality scoring system (1-5). UK SRS S2 requires financed emissions disclosure on a comply-or-explain basis from January 2027, making PCAF alignment essential.
What does the FCA anti-greenwashing rule require in practice?+
The FCA anti-greenwashing rule (effective May 2024) requires that all sustainability-related claims made by FCA-authorised firms are consistent with the sustainability profile of the product or service, are fair, clear, and not misleading, and do not omit or hide important information. This applies across all channels: fund documentation, marketing materials, website content, social media, product naming, and client communications. Firms should conduct a systematic review of all sustainability claims with documented evidence supporting each claim.
How does UK SDR differ from EU SFDR?+
UK SDR and EU SFDR share the goal of combating greenwashing but differ significantly in design. SFDR uses an entity-level classification (Article 6/8/9) based on sustainability integration and objectives, with mandatory principal adverse impact reporting. SDR uses four product-level labels with specific qualifying criteria, applies naming and marketing restrictions, and takes a more prescriptive approach to consumer-facing disclosures. For UK firms with EU-facing funds, both regimes apply simultaneously, requiring careful mapping of disclosures to avoid duplication and inconsistency.
What is the TPT framework and why does it matter for financial services?+
The Transition Plan Taskforce (TPT) Disclosure Framework, published in October 2023, provides sector-specific guidance for asset managers, asset owners, banks, and insurers on credible transition plan disclosure. FCA PS26/19 requires listed companies to disclose transition plans aligned to TPT on a disclose-or-explain basis from January 2027. The framework covers five elements: strategic ambition (including net zero commitments), implementation actions, engagement strategy (stewardship for portfolio companies), metrics and targets, and governance. It goes significantly beyond TCFD in demanding specificity and accountability.
Does CSRD apply to UK financial services firms with EU operations?+
Yes, if the EU subsidiary meets CSRD size thresholds (post-Omnibus I: EUR 450m+ net turnover). EU subsidiaries of UK financial groups must report under ESRS with double materiality assessment. Topical standards (E1-E5, S1-S4, G1) apply only where material. From FY 2028, third-country provisions may bring UK parent companies directly into scope for consolidated reporting. Financial groups should assess exposure now and build data systems that serve both UK SRS and CSRD/ESRS requirements.
Does RSustain provide FCA-regulated advice or fund management?+
No. RSustain provides ESG advisory services only. We do not provide investment advice, fund management, or any FCA-regulated activity. Our services cover sustainability disclosure preparation, data architecture design, regulatory gap analysis, anti-greenwashing reviews, financed emissions methodology, and transition plan development. All outputs are advisory and designed to support your compliance and investment teams.
How can financial services firms prepare for converging UK and EU sustainability regulation?+
The most efficient approach is an integrated data and disclosure architecture. Map SDR, UK SRS, SFDR, and CSRD requirements to identify overlapping data points (which are substantial). Build a single ESG data pipeline that feeds multiple disclosure outputs. Start with financed emissions (required across most frameworks), then layer in governance, strategy, and risk management disclosures that are common to TCFD/UK SRS/ESRS. This avoids duplicate workstreams, reduces cost, and ensures consistency across jurisdictions.
