Yes → ESOS Phase 4 applies (qualification December 2026). SECR likely applies if UK-incorporated.

3

Are you listed on the London Stock Exchange Main Market?

Yes → UK SRS S1 & S2 mandatory from January 2027. Scope 1-3, climate risks, transition plans.

4

Do you have EU subsidiaries generating EUR 150m+ net turnover?

Yes → CSRD/ESRS applies. Double materiality assessment, ESRS data points, limited assurance.

5

Do you operate or plan to develop energy infrastructure requiring EA permits?

Yes → Environmental permitting, EIA screening/scoping, BNG assessment (if new build), IED/BAT compliance.

The Challenge

Why Energy Companies Can’t Afford to Wait

Carbon pricing, tightening caps, and mandatory disclosure are converging. The cost of inaction is measurable.

Rising Carbon Costs

UK ETS allowance prices have increased significantly since scheme launch. The cap tightens annually through 2040. Every tonne of unabated emissions costs more each year — and the cost trajectory is legislated.

Disclosure Obligations Multiplying

SECR, UK SRS, ESOS reporting, and UK ETS MRV create overlapping data demands. Without an integrated approach, teams waste resources producing the same data in different formats for different regulators.

Transition Planning Pressure

Investors, regulators, and lenders expect credible net zero transition plans aligned with TPT Framework. Energy companies face the most scrutiny because their core operations are carbon-intensive.

Stranded Asset Risk

Fossil fuel assets face write-down risk as decarbonisation accelerates. Companies that cannot quantify and disclose transition risk lose investor confidence and face higher cost of capital.

Energy Sector ESG: Frequently Asked Questions

What is the UK ETS and which energy companies must comply?+
The UK Emissions Trading Scheme is a cap-and-trade system covering installations that carry out regulated activities above specified thresholds. For the energy sector, this includes power stations with rated thermal input above 20MW, large combustion plants, and refineries. Operators must hold a greenhouse gas emissions permit, submit verified annual emissions reports, and surrender sufficient UK ETS allowances to cover their emissions. The scheme replaced EU ETS participation following Brexit and operates with its own cap, which tightens annually through 2040.
How does ESOS Phase 4 differ from previous phases?+
ESOS Phase 4 introduces mandatory action plans and progress reporting, moving beyond the audit-only approach of Phases 1-3. Qualifying organisations must not only complete energy audits covering buildings, industrial processes, and transport, but also develop actionable energy efficiency plans with identified measures, estimated costs, expected savings, and implementation timelines. Progress against Phase 3 recommendations must also be reported. The qualification date is December 2026, with the compliance deadline in December 2027.
Do energy companies need to report Scope 3 emissions?+
Under UK SRS S2 (mandatory from January 2027 for listed companies), Scope 3 reporting is required on a comply-or-explain basis. For energy companies, this typically includes Category 3 (fuel- and energy-related activities not in Scope 1/2), Category 11 (use of sold products, significant for gas suppliers), Category 1 (purchased goods and services), and Category 6 (business travel). While Scope 3 is not yet mandatory under SECR, supply chain pressure from institutional investors increasingly demands it.
Can UK ETS data be used for SECR and UK SRS reporting?+
Yes, and this is the recommended approach. UK ETS verified emissions data for Scope 1 can feed directly into SECR Scope 1 disclosures and UK SRS climate metrics. However, boundary differences must be managed: UK ETS covers specific installations, while SECR and UK SRS cover the corporate entity. Energy consumed in non-ETS operations (offices, fleet, smaller sites) must be captured separately. An integrated data architecture that serves all three frameworks from a single source significantly reduces compliance cost and inconsistency risk.
What transition plan requirements apply to energy companies?+
UK SRS S2 requires companies to disclose their climate transition plans, aligned with the TPT Framework. For energy companies, this means disclosing: technology pathways for decarbonisation (renewable capacity, CCUS, hydrogen), capital expenditure plans aligned with net zero, governance arrangements for transition oversight, metrics and targets including interim milestones, and how the transition plan links to the company’s financial planning. The TPT Framework provides sector-specific guidance for energy companies. SBTi V2.0 also requires validated science-based targets with sector-appropriate pathways.
Does RSustain provide UK ETS verification?+
No. RSustain provides advisory services only. UK ETS verification must be performed by a UKAS-accredited verification body. RSustain helps energy companies prepare for verification by designing monitoring plans, building evidence architectures, conducting pre-verification walk-throughs, and optimising data collection processes. This preparation typically reduces verification time and cost, and avoids material misstatement findings.
